The key points

  • Korea’s statutory brokerage fee framework has no nationality surcharge.
  • The applicable limit depends on the property and transaction; the fee is agreed within that limit.
  • Get the calculation, VAT treatment and any additional charges in writing before signing.

Korean and international students use Korea’s brokerage fee rules when renting here. The statutory framework does not raise the fee ceiling because a renter holds a foreign passport.

However, two listings advertised as studios may fall into different fee categories. Housing, qualifying officetels and other properties can have different rules. A monthly-rent calculation also considers the refundable deposit, so provide both figures when requesting a quote.

A ceiling is not an automatic price

A statutory ceiling is the maximum permitted range. For housing, the client and registered broker agree the fee within the applicable local limits. A published maximum is not automatically the fee for every lease.

Before signing, request the property category, transaction-value calculation, applicable ceiling and agreed fee. Check whether the quote includes VAT or lists it separately, and confirm the final amount under the relevant tax treatment.

Renaming brokerage work as an interpreting or international-student support fee does not remove statutory restrictions. Receiving money beyond the permitted brokerage fee or allowable expenses can breach the Licensed Real Estate Agents Act.

Equally, not every independently requested service is automatically unlawful. Check its provider, scope, relationship to brokerage work and agreed price. Request an itemized quote rather than a package total, and keep the fee disclosure and receipt.

What to check

  1. Confirm the property and transaction category.
  2. Request a calculation using both deposit and rent.
  3. Record the agreed fee, VAT treatment and extra-service scope.
  4. Check the final total and retain disclosures, receipts and transfer records.

Common questions

Does an English consultation increase the legal ceiling?

No. Language or nationality does not itself increase the ceiling. Examine what any separately quoted service actually covers.

My friend pays the same rent but a different fee. Is that wrong?

Not necessarily. The deposit, property category, negotiated amount or VAT treatment may differ. Compare the full calculations.
