SORA RENTAL NOTE · 35

What if a room is refused because of where I come from?

How foreign students can distinguish a rejected housing application from possible discrimination, preserve useful records and seek advice in Korea.

Content checked · 3 October 2026

The key points

  • Unjustified unequal treatment based on national origin or race can fall within housing discrimination.
  • A rejected application alone does not establish discrimination; the stated reason and circumstances matter.
  • Keep the original messages and ask an adviser about your specific situation.

Take those records to an adviser. A refusal does not automatically settle the legal question.

Identify the actual reason for the refusal

Korea’s National Human Rights Commission Act includes unjustified unequal treatment based on national origin, ethnic origin or race in the supply or use of housing within its definition of discrimination. A statement excluding people from a particular country therefore deserves careful attention.

That does not mean every unsuccessful room inquiry is discriminatory. The room may have been taken, your requested dates may not fit, or the proposed contract terms may differ. Ask what requirement was not met and keep the answer. These are questions to investigate, not automatic legal excuses for exclusion.

Preserve facts that an adviser can assess

Save the original advertisement, the full message exchange and the date of the inquiry. Note who said what, the room involved and the terms you requested. If the discussion happened by phone, write a dated account soon afterwards and separate the exact words you remember from your interpretation.

A useful record explains the sequence: you asked about a room, supplied the requested information and then received a particular response. Keep relevant messages before and after the refusal rather than a single cropped sentence. You do not need to provoke another argument to make the record more dramatic.

Seek advice while keeping your housing search moving

The National Human Rights Commission provides a complaint service and the 1331 counselling line. Explain that the matter concerns access to housing and ask how to present the facts. Its complaint website also provides multilingual guidance; check how language assistance is arranged for your consultation.

A consultation is a way to assess your options. It does not guarantee compensation, a discrimination finding or a right to make that landlord sign a lease. If your semester is approaching, continue looking for accommodation while an adviser reviews the incident, and keep any already-paid money or existing contract issue clearly identified.

What to check

  1. Save the listing and the complete original conversation.
  2. Write down the date, speaker, requested lease terms and stated reason.
  3. Prepare a short factual timeline for a human-rights consultation.
  4. Keep searching for housing and track any money already paid separately.

Common questions

Does a 'no foreigners' message automatically entitle me to the room?

No. It may warrant review for discrimination, but it does not by itself give you a right to compel a lease. The facts and available procedures need individual assessment.

Should I post the landlord’s name and phone number online?

Preserve the evidence privately and ask for advice first. Public accusations or disclosure of personal details can create additional disputes and do not replace a factual complaint.
