Content checked · 3 October 2026

The key points

  • Owning the property does not give a landlord unrestricted access to your home.
  • For ordinary visits, confirm the purpose, time and visitors before agreeing.
  • You must allow necessary preservation work, but that does not create unlimited access rights.

Ownership does not remove your privacy

Korea’s Criminal Act Article 319 covers intrusion into a home and refusal to leave when required. It protects peaceful occupation. The Supreme Court has held that ownership alone does not justify forcing entry into premises occupied by someone else.

Knowing your door code or holding a spare key does not establish permission for every visit. Whether particular conduct amounts to criminal intrusion depends on the circumstances, the scope of consent and how entry occurred.

Ask what needs attention, who will attend and how long the visit should take. Suggest an available time. If you permit entry while away, record the permitted visitors and work in a message.

Under Civil Act Article 624, tenants cannot refuse work necessary to preserve the rented property. Do not simply block essential leak repairs. This duty does not authorize unrestricted entry for any inspection.

Separate emergencies from ordinary visits

  • Routine visit
  • Supporting evidence
Check these points together. The explanation below gives their relationship and conditions.

An active water leak or suspected fire differs from a routine viewing. Urgency, the extent of necessary action and whether contact was possible matter. Neither every emergency claim nor every unannounced visit has the same legal outcome.

After unexpected entry, preserve messages, dates, available access records and details of work done. Agree on a clear visiting process. If someone poses an immediate threat, prioritize getting safe and contacting emergency services.

What to check

  1. Ask about the purpose and urgency.
  2. Confirm visitors, timing and the work in writing.
  3. Specify the scope of any permission to enter while you are away.
  4. Keep available evidence of unexpected entry.

Common questions

Does sending me a message count as permission?

Notice alone does not establish consent. Existing agreements and the circumstances matter; reply clearly about availability and permission.

What about showing the room to a future tenant?

A viewing is different from urgent preservation work. Check any cooperation clause and arrange access. Such a clause does not automatically authorize unlimited visits.
